Facts:
At the conclusion of Race 1, the MAINLINE ELECTRICAL TROT, an information was lodged by Mr Allison, Stipendiary Steward, under r 870(4)(a) alleging DESOLATION ROW (Mr K Barron) which was placed 4th by the Judge was in its incorrect gait in excess of 50 metres over the final 200 metres.
Judge’s placings were:
1ST 2 DESERT BLUE
2ND 5 SNOW BOY
3RD 11 HAZEL ALICE
4TH 1 DESOLATION ROW
5th 6 LIMA LAD
Rule 870(4) provides:
Any horse which breaks from its gait in any race and (a) which fails to promptly regain its proper gait … may (in addition to any other penalty imposed pursuant to Rule 1003 hereof) subject to the provisions of the Breaking Horse Regulations made by the Board, be placed by the Judicial Committee immediately after any other horse in respect of which any advantage may have been gained.
Mr McDowell represented the connections of DESOLATION ROW.

Mr Allison demonstrated on 2 video angles that DESOLATION ROW was in a gallop at the 200 metre mark and was still galloping when it passed the 150 metres marker.
Mr McDowell agreed the distance DESOLATION ROW galloped was in excess of 50 metres.
Reasons for Decision:
The Committee is satisfied that DESOLATION ROW galloped in excess of 50 metres over the final 200 metres and thus has not promptly regained its gait. In these circumstances the horse is disqualified from 4th placing.
