As the breach was admitted we find the charge proved.

Accordingly we impose a suspension on Mr Calder from riding in races which is to start after racing on the 22nd January and to conclude after racing on the 29th January 2011 (5 riding days).

Facts:
Mr Williamson, Stipendiary Steward, demonstrated the video films which showed BRONTE WALK, ridden by Mr A Calder, near the 900 metres he allowed his mount to shift in when not sufficiently clear of RAVE REVIEW (L Innes) who was dictated into the line of RUST (A Collett) who clipped a heel and blundered.
Submissions for Decision:
Mr Williamson said in mitigation for Mr Calder was that RUST was ridden by an inexperienced rider and a more experienced rider would have eased at that point of the race, however Miss Collett was entitled to be where she was.
Mr Calder said he thought he had left sufficient room on his inside when crossing over but conceded he slightly erred.

Mr Coles said Mr Calder had 4 previous suspensions in the last 12 months. He said Mr Calder was a busy rider throughout the North Island. He submitted a suspension at the bottom end would be appropriate placing emphasis on his early admission and the mitigating factor Mr Williamson raised.
Mr Calder said he had no firm commitments in the upcoming week, however he informed the committee he was approached by Mr J Sargent today and was offered the ride on LAVANTI at Gore on the 27th January 2011.

The committee carefully considered all evidence and submissions.
Mr Calder acknowledged he was aware the starting point for careless riding is 5 days. In regards to assessing penalty we are mindful the Wellington Cup and the Karaka Million are premier events programmed for next weekend. The only mitigating factor is Mr Calder’s admission of the breach. The aggravating factors are this is Mr Calder’s 5th suspension in the last 12 months, the level of carelessness although rated at the lower end by the Stipendiary Stewards could have resulted in a fall with rider A Collett clipping a heel and falter. The committee is not convinced that Mr Calder would travel to Gore for 1 ride and took the view this was an arrangement of convenience.
