Decision:

For the above reasons, we are not satisfied that WALK THE TIGER would have beaten LADY GAGA, if interference had not occurred.  Accordingly, the protest is dismissed and the judges' placings shall stand.  We further order the payment of stakes and dividends pertinent to this result.

Facts:

Following race 7, Mr R James, Trainer of WALK THE TIGER, lodged a protest pursuant to rule 642.  He alleged that LADY GAGA, placed first by the judge, interfered with the chances of WALK THE TIGER in the final straight. 

The official margin between first and second was a short neck.

Submissions for Decision:

Mr James demonstrated the video films and pointed out to the hearing, LADY GAGA moving out considerably in the run up the straight and making contact with WALK THE TIGER.  He submitted that this caused WALK THE TIGER to lose momentum and with the short neck margin at the post, he believed this cost him the race.

Mr Waddell, Rider of WALK THE TIGER, said he was 1 1/2 lengths behind LADY GAGA when she moved out.  He said he received a brush, which caused him to stop riding.  Mr Waddell submitted that this put his horse off balance and because he was denied the opportunity  of an uninterrupted run, it prevented him from winning the race.

Mr McKee, Trainer of LADY GAGA, said he couldn't see much contact, if any, and Mr Waddell did not have to stop riding. 

Miss Johnson, Rider of LADY GAGA, said WALK THE TIGER  was running out in the run up the straight.  She said her horse followed it out and if there was any contact it was very slight.  She submitted that Mr Waddell did not stop riding his mount and she was easing down in the run to the post.

Mr Coles, when asked for his assessment of the incident, said there was minor contact between the two horses 10 strides from the post, when LADY GAGA shifted out.  He said that the committee had to consider whether WALK THE TIGER was making ground on LADY GAGA after that contact was made in the run to the post.

Reasons for Decision:

The committee considered all the evidence and reviewed the video films.  We concede that there was slight contact between LADY GAGA and WALK THE TIGER in the final stages of the race.  However, it was clear on the films, that Mr Waddell did not stop riding and we believe his momentum was only marginally impeded.  Further to that, LADY GAGA  was being eased down in the final few strides.
