Decision:

As the breach was admitted we found the charge proven.

Penalty:

Mr Ng was told the starting point for carless riding charges was now 5 days.  Because of the mitigating factors above we believe a 4 day suspension is appropriate.

Accordingly we suspend Mr Ng from riding in races which is to start after racing on 15  December and conclude after racing on 26 December 2010 (4 riding days).

Facts:

Mr Williamson demonstrated the video films which showed LOVISTE ridden by Mr Ng racing in a 3 wide position directly behind KUMARI approaching the 300 metres.  It was evident then that Mr Ng angled his mount in to clear KUMARI and gain a better run.  Mr Williamson said Mr Ng was only 1 length clear of MERCURY MISTRESS when moving in causing crowding to her and SANTANGELO who was on the rail.

Mr Noble said it was clear that Mr Ng had moved in but believed there was some inward movement by KUMARI which contributed to the incident.

Mt Ng had nothing to say.

Mr Oatham said this was Mr Ng's 4th charge in the last 12 months but he had been clear for the last 6 months which was a considerable improvement.  He submitted this breach was at the lower end of the scale but it did occur in a Group 2 race and MERCURY MISTRESS  did have to give up her rightful line of running.

Mr Noble said Mr Ng had commitments until 15 December but added that Mr Ng was not intending to ride in the South Island.

Reasons for Penalty:

The committeee considered all evidence and submissions.  Mitigating factors are Mr Ng's admission of the breach, his much improved riding record and the contribution to the incident made by KUMARI.  However MERCURY MISTRESS and SANTANGELO were both crowded at a vital stage of the race through Mr Ng moving in when insufficiently clear.
