As Mr Nolan admitted the breach the charge was found to be proved.
Penalty:
Mr Nolan’s Jockey’s License was suspended from the conclusion of racing on 3 March 2012 up to and including racing on 12 March 2012 (6 riding days). The days being; 5 March (Paeroa), 7 March (Auckland), 9 March (Otaki), 10 March (Auckland), 11 March (Waverley), 12 March (Egmont).
South Island dates were not included due to Mr Nolan advising that he would not be riding at any South Island meetings during that period.
Charge:
Following the running of Race 8 Information A3081 was filed by Stipendiary Steward Mr N Goodwin under Rule 638(1)(d). The information stated that Mr Nolan allowed his mount to shift in when not clear of “Sadist” which had to be checked approaching the 1400m.
Rule 638(1)(d) states: “a rider shall not ride a horse in a manner which the Judicial Committee considers to be …careless”
Mr Nolan acknowledged that he understood the rule and the charge.
Facts:
Mr Goodwin showed all available films of the incident and identified the horses concerned. The films showed that Mr Nolan allowed his mount “The Hombre” to shift in near the 1400m when only about 1 length clear of “Sadist” (H Tinsley). This resulted in Sadist having to be checked and forcibly restrained for a number of strides to avoid the heels of “The Hombre”.
Mr Nolan for his part said that he was trying to get in, looked to his inside, thought he was sufficiently clear when shifting, but on viewing the films said he was obviously not. In answer to a question from the committee he said that he was only 1 length clear when shifting in across the line of “The Hombre”.
Submissions for Penalty:
Mr Goodwin categorised the carelessness at the mid to low range and asked the committee to take into account that it was a Group 1 race. He said that a term of suspension was the appropriate penalty.
It was established that Mr Nolan has had one suspension only for careless riding in the last 12 months, that suspension being imposed in Ireland.
Mr Nolan asked that any suspension imposed, start after racing on 3 March 2012.
