Mr Lammas admitted the breach therefore it was found to be proved.
Penalty:
Accordingly Mr Lammas is suspended from the close of racing on Saturday November 13th until the close of racing on Saturday November 20th.
Charge:
An information was filed by Mr N Goodwin alleging a breach of Rule 636(1)(c) in that B Lammas relaxed his ride on Aunt Daisy over the concluding stages losing 4th place
Facts:
Mr Goodwin used the film to outline the incident to the committee. Just short of the line Mr Lammas was observed to relax his ride on Aunt Daisy for approximately 2 ½ strides. A horse coming down the outside beat him by a nose margin. Prior to stopping riding Mr Lammas was holding 4th position and ended up finishing in 5th place.
In response Mr Lammas told the committee that over the final stages Aunt Daisy was getting tired and lugged in down the home straight. He did not want to punish a horse that had nothing left to give.
Submissions for Penalty:
Mr Goodwin said Mr Lammas had not breached this rule before today. There have been few cases where riders have missed out on a 4th placing. There was a recent charge where a rider relaxed when running 2nd and there have been cases involving 5th and 6th places but this case was unusual.
Penalties are generally decided on a sliding scale where the higher the placing lost the more significant the penalty imposed. Riders who have lost 1st, 2nd or 3rd placings have received penalties in the vicinity of two to six week suspensions and riders who have lost 5th or 6th placing have received fines only.
In this case the race was a “First 4” therefore punters with that type of bet have been affected and the owners of Aunt Daisy have missed out on approximately $265- the difference in stake money between 4th and 5th.
Mr Goodwin’s submission for this offence was for a 5 day suspension due to the fact that First 4 punters who had Aunt Daisy in their selections missed out on a dividend.
Mr Lammas said that he would prefer a fine but if a suspension was considered he had riding commitments at Otaki on Thursday and on Saturday at Tauranga.
Reasons for Penalty:
In coming to a decision on penalty the committee considered all of the submissions including Mr Lammas’s admission of the breach and his excellent record.
While we accept that Aunt Daisy was tiring Mr Lammas has a clear obligation under the rules to continue riding out to the finish. With only a few strides to go to the finish line he did not have to “punish” his horse to maintain fourth position. There was more than a reasonable chance that if he had not relaxed his ride then he would have retained fourth place.
It was the opinion of the committee that a monetary penalty would not truly reflect the gravity of the breach. A fine might well have been suitable if all that was at stake was the $265 difference in prize money however this was a race where dividends were paid out for the first four horses across the line. An error of judgement by Mr Lammas has cost First 4 punters.
It is our opinion that a suspension of 4 days is appropriate taking into account other breaches of this rule.
