As Mr Lennox admitted the breach the charge was found proved.

Charge:
Mr Neal lodged an information alleging a breach of rule 534 (1) in that Mr Lennox scratched HERMAN MUNSTER subsequent to the scratching deadline.
Facts:
Mr Lennox is a Licensed Trainer from Waverley. He arrived on track at Otaki and realised that the track conditions were much worse than he had expected. He based this on the race times from the first two races run. Mr Lennox believed racing his horse (its first run in a new preparation) would be too hard on it on a very heavy track.
Mr Lennox requested a Ruling from the Judicial Committee in that he be allowed to scratch his horse after the official deadline but this was declined by the Committee (see Request for a Ruling).
Subsequently Mr Lennox did scratch HERMAN MUNSTER from Race 7 and therefore faced a charge under Rule 543 (1).
Submissions for Penalty:
Mr Neal said there had been four previous breaches of this rule with fines ranging from $150 to $400. The higher fine was incurred when a trainer late-scratched 2 horses preventing 2 balloted horses from gaining a start on race day. Mr Neal submitted a lower fine was appropriate in this situation.
Mr Lennox had thoroughly explained his situation in the prior hearing, where the Judicial Committee considered his request for a Ruling, and had nothing further to add.
Reasons for Penalty:
The committee considered all of the submissions. Mr Lennox had valid reasons for not starting his horse but was required to scratch prior to 7.30am on race day. He erred in his assessment of the track conditions changing his opinion once the meeting was well under way. The mistake resulted in him facing this charge. In coming to a decision on penalty the committee noted that no horse had been denied a start as a result of the late scratching. We placed this breach at the lower end of the scale and in setting penalty gave weight to previous penalties imposed under similar circumstances.
