Mr Bishop is suspended from the close of racing on 31 July until the close of racing on Wednesday 12 August 2020. 

Facts:

Following the running of Race 8 (Dixon and Dunlop Maiden 1200) Information A12332 was filed with the Judicial Committee. It alleged a breach of Rule 638(1)(d) in that “R Bishop (THATZ DAISY) allowed his mount to shift in when insufficiently clear of TRANSITORY which was hampered and forced in on OUTA CASH which was also hampered near the 1000 metres.”

Mr Bishop confirmed that he understood the Rule, and that he admitted the breach.

Using the back straight film Mr Goodwin identified Mr Bishop (THATZ DAISY), who had drawn barrier 12, with other runners to his inside; specifically TRANSITORY (S Weatherley) in barrier eight and OUTA CASH (L Allpress) in barrier six.

Soon after the start Mr Bishop had angled for a run closer to the running rail, in an attempt to go clear of Mr Weatherly. In doing so Mr Bishop had moved into the line of Mr Weatherly who had to take evasive action resulting in firm contact with Mrs Allpress. This forced her across heels causing INFARED (L Hemi) to be hampered as a result. Mr Goodwin submitted that in Mr Bishop's attempt to move closer to the rail he was not the required distance clear.

Mr Bishop accepted Mr Goodwin's analysis of the incident, indicating that he understood he had rolled in on top of the runners to his inside.

Submissions for Penalty:

In presenting Mr Bishop's record, Mr Goodwin identified no previous breaches of the Rule within the previous 12 months. He submitted that the event had occurred at the start of the race and as the Respondent was not the required distance clear the level of carelessness was assessed as within the low range. He submitted a period of suspension as appropriate.

Mr Bishop advised the Committee that he was starting to get back into riding. He agreed that the offending was low level carelessness and that a period of suspension must follow. He did not seek a deferral of any of suspension. 

Reasons for Penalty:

Soon after the start, Mr Bishop has sought a run closer to the running rail. This required him to cross ground from a wide draw. In doing so, he has not been the required distance clear of TRANSITORY. This meant the rider of that horse had to take action resulting in some firm contact with OUTA CASH. It is clear the latter runner suffered the most inconvenience which had a flow on impact upon Miss Hemi (INFARED). The Committee assesses the level of carelessness at the low end and considered his record and admission of the breach. It also considers a period of suspension as appropriate. That period of suspension will be three days.
