Mr Larsen admitted the breach and it is found proved.

Mr Larsen is suspended from the end of racing today, up to and including the 6th August 2020 (3 days).

Facts:

Mr Tristan Larsen (DUKE OF DUNDEE) was charged with a breach of r 869 (2) and the Whip Regulations (b) in that he used his whip excessively in Race 5. Mr Larsen admitted the breach and appeared at the hearing assisted by Mr Gray.

Mr Munro, with the use of the videos, stated DUKE OF DUNDEE was trailing three deep on the pole line approaching the home straight. Mr Larsen was observed to use his whip in an excessive manner from inside the 400 metres to the finish line. Miss Haley stated Mr Larsen used his whip 11 times. He did attempt to break up the whip use but it was still excessive.

Mr Larsen accepted the evidence of the Stewards. Mr Gray stated Mr Larsen was just over the limit and needed to work on his whip action.

Miss Haley stated Mr Larsen was in his first full season of driving and had had 39 drives this season. He had been fined $200 for a similar offence on the 9th July and this was his second charge inside six months. Under the JCA Penalty Guide she sought a suspension of three days. Mr Gray said Mr Larsen was a Junior Horseman and that he was just over the limit.

Reasons for Penalty:

This is Mr Larsen’s second breach of the rule within a week. While Mr Larsen admitted the breach at the outset, the Penalty Guide does not allow any discretion as to penalty and a suspension is inevitable.
