Facts:
Following the running of race 7, the Youngman & Son Handicap Trot, an information instigating a protest was filed by Chief Stipendiary Steward Mr N Ydgren, against SHOW ME THE GRAY (R Close), placed 4th by the judge, on the grounds that it “galloped in excess of 150 metres in the early stages” thereby breaching Rule 870(3) and the Breaking Horse Regulations.
Mr Close confirmed to the Committee that he was representing the connections of SHOW ME THE GRAY.
The official placings for the race were:
1st – 1 TEHORO TEASE
2nd – 11 IN THE VALLEY
3rd – 13 THE BLOSS
4th – 8 SHOW ME THE GRAY
5th – 7 RACHMANINOV
6th – 9 DON’T ROCK THE BOAT
Rule 870(3) provides: that any horse which breaks from its gait during a race must promptly return to its correct gait.
Relevant clauses from the Breaking Horse Regulations state: -
(a)-Any horse which breaks from it’s gait either at the start or during the running of any race and continues on in a break for a distance of 150 metres or greater shall be in breach of Rule 870(3) in that it has failed to properly regain it’s proper gait.
Provided that where such first mentioned horse is not in the correct gait as a result of interference to such horse or it’s horseman then [subject to Rule 869A] such relegation or disqualification of the horse shall be at the discretion of the Judicial Committee.
Submissions for Decision:
Mr Ydgren with the assistance of Mr Renault showed the race video replay of the first 300 metres of the race. He identified SHOW ME THE GRAY who had began well and was in fourth place. At approximately 100 metres before the winning post CABELLA NOIR (C Thornley), who was directly in front of Mr Close, galloped and as Mr Close quickly angled out to avoid this horse, galloped himself.
Mr Ydgren said the Stewards calculated SHOW ME THE GRAY was in a gallop for 80 metres to the winning post and another 100 metres beyond which was clearly more than the 150 metres allowed in the Regulations.
Mr Close demonstrated the incident and explained why he was unable to pull his horse back to regain its gait. He pointed to a horse behind him and several others in very close proximity which prevented him from restraining his horse to an extent for it begin trotting again.
Reasons for Decision:
The Committee was satisfied that SHOW ME THE GRAY had broken from its gait, for more than 150 metres, but the circumstances around this horse was a compelling factor. It was clear that CABELLA NOIR galloping in front of SHOW ME THE GRAY was the only reason why it galloped itself. Mr Close, from the time SHOW ME THE GRAY broke stride, has kept his horse straight and resisted restraining his horse to regain it’s gait so as to not interfere with other runners.
Mr Ydgren was of the opinion that SHOW ME THE GRAY certainly gained no advantage and there was no doubt the horse broke from its gait because of interference.
The Committee after considering all the evidence and viewing the available films used its discretion under the Rules and dismissed the Protest.
