As the breach was admitted we find the charge proved.
Penalty:
After taking all the above factors into account the committee has determined the appropriate penalty is a 5 day suspension. Accordingly we impose a suspension on Miss Vance from riding in races which is to start after racing on 4 February and conclude after racing on 12 February 2011 (5 days).

Facts:
The informant Mr George alleged that approaching the 800 metres Miss M Vance (SAN LEONARDO) allowed her mount to shift in when not sufficiently clear of TRY TIME (Mrs T Thornton) who was checked.
Submissions for Decision:
Mr Williamson pointed out to the committee Miss Vance riding SAN LEONARDO racing in a 3 wide position approaching the 800 metres. Racing on her inside was TRY TIME ridden by Mrs T Thornton. Mr Williamson submitted that soon after the 800 metres Miss Vance allowed her mount to move in and take the line of TRY TIME when insufficiently clear. He said that as a result Mrs Thornton received a sharp check through her having to take a strong hold.
Miss Vance while admitting the breach said she thought Mrs Thornton's mount may have been overracing therefore contributing to the interference.

Mr George said Miss Vance had incurred 2 suspensions in the last 12 months which was a good record. He submitted her level of carelessness in today's charge was in the mid range.
Miss Vance said she had commitments until after racing on 4 February 2011.
Reasons for Penalty:
The committee carefully considered all the evidence and submissions as presented. Mitigating factors in this charge are Miss Vance's admission of the breach and her good record. However the committee is satisfied the check received by Mrs Thornton was due soley to the inward movement of Miss Vance when not the required distance clear of Try Time. The check received by Mrs Thornton was quite a severe one and as pointed out to Miss Vance it was fortunate that Mrs Thornton is such a strong rider as she could have easily been in more trouble than she was.
