Mr Beeharry is suspended from the end of racing on 23 January 2021 up to and including 31 January. This is 4 days, and he is fined the sum of $250.
Facts:
Following the running of Race 4 the Stewards charged Mr R Beeharry (BELLE FASCINO) with a breach of r 638(1)(d) in that he permitted his mount to shift inwards near the 1200 metres when not clear checking MEARA MARY.
Mr McIntyre demonstrated on the videos that Mr Beeharry shifted inwards shortly after the start. In so doing he has checked Ms Comignaghi on MEARA MARY. The side-on video evidenced that the Respondent was not his length and another clear at the time.
Mr Walsh said the Respondent was almost a length and a half clear. He said Mr Beeharry had just needed to press on perhaps for 4 or 5 more strides and he would have been okay. However, he had not.
Mr Beeharry said he had looked to his inside and was aware MEARA MARY was there. He thought he was clear. He could see now he should have just pressed forward.
Submissions for Penalty:
Mr Davidson produced Mr Beeharry’s record which showed two previous breaches of this rule in the last 12 months. This was Mr Beeharry’s first breach since the Covid pause. Mr Davidson said this was “not a terrible record” considering the fact Mr Beeharry would have 4 or 5 rides a meeting. He described the breach as the Respondent trying to “reverse park”. He assessed it as being mid to low-range.
Mr Beeharry sought a deferment of the suspension until after racing at Gore on 23 January.

The NZTR Revised Penalty Guidelines for careless riding provide a starting point of a $250 fine and a 4-day suspension for a low-range breach. The Committee accepts the Informant’s description of the breach as being mid to low range is correct. Mr Beeharry shortly after the start has tried to shift into a position on the fence but has miscalculated. Ms Comignaghi has been checked as a consequence. Taking this into account, together with Mr Beeharry’s record and his admission of the breach, a one day deduction from a 5-day starting point is appropriate.
