The breach is admitted and therefore the charge is proved.

Penalty:

The Committee accordingly orders that Mr Cooksley's Licence to ride is suspended from the conclusion of racing on the 21st of December 2017 to after the conclusion of racing on the 27th of December 2017.

Facts:

Following the running of the NORTHLAND WASTE, an Information was lodged by Stipendiary Steward, Mr A Coles against Class A Rider Mr G Cooksley alleging that Mr Cooksley riding DALGUINN allowed his mount to shift in near the 900 metres mark when not sufficiently clear of WINNIE'S RAINBOW which was dictated onto KWIK STRYDER which was checked.

Rule 638(1)(d) provides: a Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Mr Cooksley was present at the Hearing and he acknowledged that he understood the Rule and he admitted the breach.

Senior Stipendiary Steward, Mr M Williamson demonstrated the incident using the available race films. He showed where at about the 900 metres mark DALGUINN was racing on the outside of WINNIE'S RAINBOW and KWIK STRYDA was back on its inside. He said that Mr Cooksley moved DALGUINN inwards onto WINNIE'S RAINBOW and it then moved in onto KWIK STRYDA which was checked and struck the running rail.

Mr Cooksley said that he had been pushed out but when he moved back in he was not quite clear of the inside horse.

Submissions for Penalty:

Mr Coles said that Mr Cooksley had a very good record and he had one previous charge under this Rule. This was on the 17th of November also at Ruakaka and it was mid range interference and he received a 6 day suspension.

He said that in the incident WINNIE'S RAINBOW had overreacted and he further said that the incident was in the low range of seriousness. He said that the Committee should take this into account. He further said that Mr Cooksley should be given credit for his very good record and his admission of the breach.

Mr Cooksley did not present any penalty submissions.

When asked by the Committee about his riding engagements Mr Cooksley said he was riding at Matamata on the 20th of December but he did not have any engagements after that. The Committee specifically asked Mr Cooksley if he wanted a deferment of suspension until after the Ellerslie meeting on Boxing Day so that he could ride there and also at Te Rapa in the interim. He said he was not riding at either meeting and he wanted his suspension to commence immediately after the Matamata meeting.

Reasons for Penalty:

The Committee carefully reviewed the race films and also considered the evidence presented to us. The films clearly show the inwards movement by Mr Cooksley and the resultant interference to the 2 other horses on his inside.

We deem the incident to be low range. We have given Mr Cooksley credit for his admission of the breach and his very good record. We have taken the starting point of 6 National Riding days and we consider that after taking all matters into account that a penalty of 5 National Riding days is appropriate.

The Committee pointed out to Mr Cooksley that we could not take the Otaki Race Meeting on the 21st of December 2017 into account  because Declaration of Riders for that meeting closed at 4pm today. We further pointed out that although this charge was out of Race 2 today which was run at 2.12pm the Information did not come to the Committee until well after 4pm and as a result the hearing was at 4.25pm.
