As Mr Dell admitted the breach, it was deemed to be proved.

Penalty:

Accordingly, Mr Dell’s riding license is suspended from the close of racing on Saturday, 12 September up to and including racing on Friday, 18 September 2020.

Facts:

Following the running of Race 6 (LISTED HS Dyke Wanganui Guineas 1200m), an Information was lodged by Mr Goodwin alleging a breach of Rule 638(1)(d) in that C Dell FLASH WARRIOR permitted his mount to shift out near the 250 when insufficiently clear of ALICE TINKER which was hampered.

Mr Goodwin used the video to show Mr Dell’s position in the field soon after turning for home. He was in the centre of the track and riding with vigour when he angled outwards and bumped the mount of Ms Taiaroa. The interference caused her horse, ALICE TINKER, to become unbalanced which resulted in buffeting between the 2 horses for several strides.

Mr Dell said the prevailing track conditions meant that the horses were getting tired earlier in the race, inferring that this may have contributed to the incident.

Submissions for Penalty:

Neither Mr Goodwin nor Mr Dell could remember when Mr Dell last breached the careless riding Rule.

In response to a question from the Committee Mr Dell said he had approximately 200 rides last season. Mr Goodwin described today’s breach as below midrange and submitted that a term of suspension be imposed.

Mr Dell said he very rarely rides outside of the Northern region and advised of riding commitments through until next Saturday.

Reasons for Penalty:

The Committee considered all submissions.

Mr Dell clearly allowed his mount to move outwards 2-3 horse widths resulting in contact with ALICE TINKER. No other horses contributed to his outward movement. The resultant interference affected Mr Dell’s own horse (FLASH WARRIOR) and ALICE TINKER, and almost certainly influenced the line of running of horses in behind these two runners. The degree of carelessness was in the midrange and dictates that a suspension is an appropriate penalty.

Mitigating factors were Mr Dell’s excellent record and his admission of the breach although we acknowledge it would have been a difficult charge to defend. An aggravating factor was the Listed Status of the race. Under normal circumstances the Committee would look at imposing a suspension of 6-7 days duration however the impact of Covid 19 on racing, and the restrictions this has brought, has been taken into account. Balancing up all factors, it was the Committee’s opinion that a suspension of 3 days was appropriate.
