Facts:
Following the running of race 6, the Mike Hurring Logging Ltd Handicap Trot, a Protest Information was lodged by Stipendiary Steward, Mr Tidmarsh alleging PYRAMID MAGIC broke from its gait about the 800 metres mark when trailing and galloped in excess of 150 metres. He was seeking the disqualification of PYRAMID MAGIC under rr 870(3) and 1003(2).
Rule 870(3) reads: that any horse which breaks from its gait shall promptly retain its gait.
The Breaking Horse Regulations part (a) reads: that any horse that breaks from its gait either at the start or during the running of the race and continues on in the break for a distance of 150 metres or greater shall be deemed to be in breach of Rule 870(3)
Rule 1003(2) reads: Every horse which commits a Breach of any Rule shall be liable for the following penalties:-
(a) to be disqualified or scratched from any race.

Submissions for Decision:
With the aid of the videos Mr Tidmarsh demonstrated that PYRAMID MAGIC was trailing approaching the 800 metre mark. Shortly after passing that mark PYRAMID MAGIC broke free of interference and galloped in excess of 150 metres before regaining its gait. Mr Tidmarsh stated that PYRAMID MAGIC galloped for approximately 170 metres. Pyramid Magic regained its gait and finished on to be placed third by the judge. He was seeking the disqualification of the horse.
Mr Barclay signed the information and indicated he did not contest the Protest.
Reasons for Decision:
After viewing the videos the committee was satisfied that PYRAMID MAGIC was in breach of r 870(3) in that it galloped for some 165 to 170 metres. As the horse had gained an advantage over the rest of the field it was disqualified from third placing pursuant to r 1003(2).
