Decision:

As Mr Nason admitted the breach the Committee found the charge proved.

Penalty:

The Committee grants a deferment to Mr Nason’s suspension pursuant to Rule 1106(2).

Accordingly, Mr Nason had his license to ride in races suspended for a period to commence after racing on 21 February and conclude after racing on 1 March 2018.

Facts:

Following the running of race 5, Vector Wero Whitewater Park 1600, an Information was filed pursuant to Rule 638(1)(d).The Informant, Mr Oatham, alleged that Mr Nason permitted his mount SOUTHERN PRINCESS to shift outwards into the line of LUCKY SWEEP passing the 50 metres with LUCKY SWEEP having to be steadied.

Rule 638(1) (d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Mr Nason acknowledged that he understood the Rule and he admitted the breach. Mr Harris assisted Mr Nason at the hearing.

Mr Coles demonstrated the incident using the available video footage. He said that Mr Nason rode his mount forward with the whip inside the 200 metres and SOUTHERN PRINCESS continued to shift outwards. He said Mr Nason shifted out a good 3 horse widths which resulted in LUCKY SWEEP being crowded for about 6 strides. He added that Mr Nason only stopped riding his mount for 1 stride.

Mr Nason said that his mount was distracted by the infield big screen and this contributed to the incident. He said that he tried to straighten his mount but stated his effort was not satisfactory.

Mr Harris said that he has advised Mr Nason to “slow down” his English style of riding.

Submissions for Penalty:

Mr Oatham produced Mr Nason’s record which showed 1 previous breach under this Rule in the last 12 months. He said it was a relatively good record but Mr Nason clearly allowed his mount to shift out a considerable distance over the final stages of the race. He said that LUCKY SWEEP was in contention for 2nd placing and that runner was entitled to a fair run to the finish line. He said weighing up all factors the Stewards considered that the carelessness was a little below midrange. He said to Mr Nason’s credit was his admission of the breach and his good record. Mr Oatham submitted that a 6 to 7 days suspension should be imposed.

Mr Nason advised that he had engagements at Avondale on 21 February and any proposed suspension could start after that date. He asked the Committee to consider his admission of the breach and his good record.

Mr Harris submitted that Mr Nason was a good student and he was recommending that Mr Nason adjusts his English style of riding.

Reasons for Penalty:

The Committee carefully considered all the evidence and submissions presented.

When reviewing the incident the Committee deemed the level of carelessness displayed by Mr Nason was in the low to midrange. The Committee adopted 7 days as the appropriate starting point.

There were no aggravating factors.

The mitigating factors were Mr Nason’s admission of the breach and his very good record. For these combined factors we afforded Mr Nason a 1 day reduction in penalty.

After taking into account all the above factors the Committee considered that an appropriate suspension was 6 national riding days.
