The breach is admitted and therefore the charge is proved.

Penalty:

The Committee orders that Ms Fawcett's Rider's Licence is suspended from after the conclusion of racing on the 19th of July 2020 to after the conclusion of racing on the 24th of July 2020. That is 2 National Riding days.

Facts:

Following the running of the STEELMAC TRADING LTD 1600 an Information was lodged by Stipendiary Steward Mr A Coles against rider Ms J Fawcett alleging that Ms Fawcett allowed her mount TEEN TITAN to shift out crowding TUNZAGUTZ out onto PLUSHENKO which was checked near the 400 metres mark.

Rule 638(1)(d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.

Ms Fawcett was present at the Hearing and she advised the Committee that she understood the Rule and that she admitted the breach. Ms Fawcett was supported by Mr N Harris.

Stipendiary Steward Mr B Jones demonstrated the incident by use of the race films. He identified the 3 horses and riders involved in the incident. He showed where on the home turn TEEN TITAN was on the inside of the other 2 horses and at about the 400 metres mark it shifted out crowding TUNZAGUTZ which was then pushed out onto PLUSHENKO which was checked. Using another film angle he showed where TEEN TITAN was only about three quarters of a length in front of TUNZAGUTZ and accordingly was not sufficiently clear.

Ms Fawcett said that she made an error of judgement. She said that she heard the other 2 riders Ms Newman and Ms Collett call out to her and she immediately took corrective action but she said she was one second too late.

Mr Harris said that the final bend is difficult particularly out wide as these horses were. He said jockeys including senior jockeys can find the corner confusing.

Submissions for Penalty:

Mr Coles said that Ms Fawcett had 2 prior charges under this Rule in the previous 12 months being in October and December 2019.

He said that the incident was at the low end of seriousness and that Ms Fawcett has an average record. Mr Coles submitted that an appropriate penalty would be a suspension for at least 2 days.

Ms Fawcett pointed to it being an error of judgement on her part and also to the fact that it was seven months since her last breach of this Rule.

Reasons for Penalty:

The films show the incident clearly and although Ms Fawcett has admitted the breach that was inevitable in view of the film evidence. This was a difficult day for riders due to the weather conditions and the Committee accepts that this was an error of judgement on Ms Fawcett's part. It is also clear that once alerted to it by the other 2 riders she took corrective action.

The Committee also takes into account the fact that these are difficult times for everyone due to the Covid pandemic and accordingly any penalty would be less than normal. That is also reflected in Mr Coles' submission.

Taking all matters into account the Committee accepts that a 2 day suspension is appropriate.

Ms Fawcett has asked for a deferment of any suspension until after the Timaru Racing Club meeting on the 19th of July 2020 because she has confirmed rides there.

The Committee therefore grants Ms Fawcett a deferment of suspension pursuant to Rule 1106(2) until after the conclusion of racing on the 19th of July 2020.
