Facts:
Following the running of Race 6, the Kevin Greaney Memorial Handicap Pace, an information was filed by Stipendiary Steward, Mr S Wallis, against Licensed Junior Horseman, Mr S Golding alleging that Mr Golding, as the driver of DESTINED FOR GLORY in the race, drove in a careless manner by allowing his horse to improve outwards when not entitled to, which placed STERNS ARISING in restricted room.
Mr Golding had indicated on the information that the breach was admitted. He also informed the Committee that he understood the rule he was being charged with and that he did not wish to have representation at the hearing as he was entitled to as a Junior Driver.
Rule 869 (3) (b provides as follows:
(3) No horseman in any race shall drive:-
(b) carelessly;
Mr Wallis gave evidence and replayed video films of the incident, with the assistance of Stipendiary Steward, Mr S Renault, to show that near the 200m Mr Golding, driving DESTINED FOR GLORY, was racing in a prominent position on the inside of STERNS ARISING, driven by Mr J Dunn who was in turn racing on the inside of ROXY BROMAC, driven by Miss J Young. Mr Golding, when looking to improve, allowed DESTINED FOR GLORY, to shift out and into the line of STERNS ARISING when attempting to take a gap that presented ahead of that horse. STERNS ARISING was checked and broke momentarily in this incident losing several lengths and its chance with DESTINED FOR GLORY finishing in 3rd place. Mr Renault submitted that the run for Mr Golding was never available and there was never a clear gap for Mr Golding to improve into.
Mr Golding stated that he was travelling well at the time and Mr Dunn had called to him to say there was room to improve but that he had misjudged it and had caused the incident. He said that had he waited for 20m more the run would have presented itself to improve into.
Submissions for Penalty:
Mr Wallis told the Committee that Mr Golding is a busy junior driver who has so far this season driven on 103 occasions and last season had a total of 237 drives. He said Mr Golding’s record showed a previous breach of this rule on 24 April 2014 at Addington where he was fined the sum of $300. Mr Wallis submitted that credit should be given for his admission of the breach and that Mr Golding’s record was reasonable considering the number of drives he has had since his last breach. He stated that the Stewards believed the level of the breach to be low. Mr Wallis submitted that a fine of $300 should be considered as penalty in this case.
Discussion was held with Mr Golding in regard to whether a suspension or a fine would be his preference with Mr Golding opting to submit that a fine be imposed.

In determining penalty the Committee took into account Mr Golding’s reasonable penalty record and his ready admission of the breach. The Committee agreed with the Stewards in assessing the breach at low level. The JCA Penalty Guide provides a starting point of 8 drives or a $400 fine for a breach of this rule. In taking that starting point we were able to give Mr Golding a discount of $50 for his reasonable record - 8 months since his last breach and the low level of the breach with a further $50 for his admission of the breach. We therefore determined that a fine of $300 was an appropriate penalty in this case.
