As Miss Wynne had admitted this breach of the Rules it was found to be proved.

Penalty:

Accordingly, Miss Wynne’s Class A licence was suspended from the conclusion of racing on 5 January up to and including 15 January 2020.

Facts:

Following the running of Race 3 an Information was filed by Stipendiary Steward, Mr M Davidson, against Class A Licensed Jockey, Miss S Wynne, the rider of EXPRESSIVE, in that she permitted her mount to shift inwards when not sufficiently clear of ATAAHUALUVTHEDREAM which was checked near the 150m.

Rule 638(1)(d) reads as follows;

“(1) A Rider shall not ride a horse in a manner which the Judicial Committee considers to be:

      (d) careless”

Miss Wynne had indicated on the Information that this breach of the Rules was admitted which she confirmed at the hearing. Miss Wynne also agreed that she understood the charge and the Rule it was brought under.

Mr Davidson gave evidence and used video coverage with the assistance of Chief Stipendiary Steward, Mr J Oatham, to show that approaching the 150m, EXPRESSIVE, ridden by Miss Wynne, was racing approximately 3 off the rail with ATAAHUALUVTHEDREAM, ridden by Mr T Moseley, racing on the fence and inside Miss Wynne. Mr Oatham demonstrated on the head on film, Miss Wynne angle her mount inwards, when looking for racing room, and shift into the racing line of ATAAHUALUVTHEDREAM, when not clear, causing that horse to check. He added that Miss Wynne did take action to straighten, albeit too late to avoid taking Mr Moseley’s line.

Miss Wynne stated that her horse was gawking at the other runners in the field, particularly Miss Comignaghi’s mount, who was immediately ahead and shifted quicker across than she anticipated which contributed to the incident.

Submissions for Penalty:

Mr Davidson stated that the Stewards assessed the breach as low range. He said that Miss Wynne’s penalty record showed 3 breaches of this rule over the previous 12 months being 11 October at South Canterbury (7 days), 13 November at Riccarton (8 days) and Riccarton 16 November (7) days. He stated that the JCA Penalty Guide provided a 6-national day suspension for a low-level breach of this Rule and submitted that credit be given for Miss Wynne’s admission of the breach.

Deferment of penalty was discussed with Miss Wynne deciding to take any suspension imposed, immediately.

Reasons for Penalty:

The JCA Penalty Guide provides a starting point for a low-level breach of this rule of a 6-national day suspension. We agreed with the Stewards that the breach was at a low level and therefore adopted the 6-national day starting point. The aggravating factor to consider was Miss Wynne’s penalty record which warranted an uplift of penalty, which we set at 1 day. We were however able to afford Miss Wynne a discount for her admission of the breach, which we set at 1 day. The Committee therefore determined that a 6-National day suspension was an appropriate penalty in this case.
