Facts:
Following the running of race 8 the MLT PIONEER TAVERN TROT Stewards lodged a Protest under r870 (3) and the Breaking Horse Regulations against the fifth placed SUNNIVUE PHILEAH. The Information alleged that SUNNIVUE PHILEAH broke from its gait shortly after the start and galloped more than 150 metres before returning to its proper gait. The connections of SUNNIVUE PHILEAH did not contest the Protest.

Ms Haley, with the use of the videos, stated that SUNNIVUE PHILEAH trotted off the mark but approaching the first bend broke free of interference. Its driver Mr Campbell took the horse clear of the field. However, it continued on in a gallop for some distance. Ms Haley estimated that SUNNIVUE PHILEAH was not in its correct gait for in excess of 150 metres. She sought disqualification under r870 (3).
Reasons for Decision:
The Protest was not contested by the connections and it is upheld.
