Facts:

Mr Renault sought the relegation of PURE SUCCESS in race 1, the CARPET PLUS WILLY’S FLOORING TROT, on the ground that the horse was in a gallop when it crossed the winning post and was lapped on by LOXI CLAIRBORNE. 

Judge’s placings were:

1ST 5 GRACE LIGHTNING
2ND 1 EASY MOMENT
3RD 3 ABRAHAM JONES
4TH 7 PURE SUCCESS
5th 8 LOXI CLAIRBORNE

The relevant rules and regulations provide:

870(3) Any horse which breaks from its gait shall promptly regain its proper gait.

870(4) Any horse which breaks from its gait in any race and (d) which fails to lose ground by the break may (in addition to any other penalty imposed pursuant to Rule 1003 hereof) subject to the provisions of the Breaking Horse Regulations made by the Board, be placed by the Judicial Committee immediately after any other horse in respect of which any advantage may have been gained.

Rule 870(5) states:

Notwithstanding the provisions of sub-rule (4) hereof any horse which is not in the correct gait when its nose reaches the finishing line and which is lapped on by any other horse or horses in the correct gait shall be placed by the Judicial Committee behind such horse or horses provided that where such first mentioned horse is not in its correct gait as a result of interference to such horse or its horseman, then (subject to Rule 869(8)) such relegation of the horse shall be at the discretion of the Judicial Committee.

Submissions for Decision:

Mr Renault demonstrated that PURE SUCCESS came into contact with GRACE LIGHTNING and was in a gallop when the horse crossed the finishing line. The margin between 4th and 5th was half a head.

Ms Buchan agreed, after studying the videos, that PURE SUCCESS was galloping when the horse crossed the line and that it was lapped on by LOXI CLAIRBORNE.

Reasons for Decision:

We have viewed the two relevant video angles on a number of occasions and it is clear that PURE SUCCESS has gone onto a gallop a stride or two before the winning post. Both parties are of a similar view. There was no interference to PURE SUCCESS from any other horse. In these circumstances we are satisfied PURE SUCCESS was not in its correct gait when it crossed the line and was lapped on by LOXI CLAIRBORNE. We thus relegate PURE SUCCESS to behind LOXI CLAIRBORNE.
