Decision:

As Mr Walker has admitted the charge, it is deemed to be proved.

Penalty:

Mr Walker's rider's licence is suspended for 6 New Zealand race days.

His application for a deferment is granted.

His period of suspension comes into effect at the conclusion of racing on Sunday 18th November, and will conclude at the conclusion of racing on Sunday 25th November 2012.

Charge:

It was alleged that Mr Walker angled his mount "Savour The Moment" outwards near the 300 metres when not sufficiently clear of "Chaparella" which was checked becoming unbalanced.

Facts:

The incident was shown to the hearing on the video coverage from side-on and rear-on camera views. Mr Walker's mount was "full of running", as it came up on the inside of "Chaparella" ridden by Ms K Williams. Contact was made and as a consequence, "Chaparella" was moved out several horse widths and became unbalanced.

Submissions for Penalty:

The Stipendiary Stewards advised the hearing that Mr Walker had received 4 suspensions in the past 12 months, on 22nd February, 5th April, 15th May and 22nd June 2012.

We were also urged to note the status of the race, namely a Group 2 race for a stake of $230,000. It was also submitted that Mr Walker deliberately angled his mount outwards to seek running room and that such actions placed the degree of carelessness at the upper end of the scale.

Mr Walker told the hearing that he had riding engagements in Australia and applied for a suspension of the coming into effect of the period of suspension.

Reasons for Penalty:

Our starting point for the imposition of penalty is a suspension of rider's licence for a period of 5 New Zealand race days.

Against that, we must take into account mitigating and aggravating features.

The aggravating feature in this case is the degree of carelessness. Mr Walker deliberately angled his mount out to obtain running room. That action was over and above "competitive riding". It was deliberate and "Chaparella" was quite significantly inconvenienced.

In terms of Rule 920(2) we must also have regard to the status of the race (Group 2) and the stakes competed for ($230,000).

These factors provide an uplift on our starting point, of 3 days, making the penalty, a suspension of 8 days.

Against that, we allow Mr Walker  credit for his early admission of the charge and the fact that he is a busy professional rider. That enables us to discount the penalty by 2 days, making the period of suspension, 6 days.
