Hawke’s Bay RI 26 May 2021 – R 6 – Chair, Mr N McCutcheon
ID: JCA10620
Code:
Thoroughbred
Meet Title:
Hawkes Bay RI - 26 May 2021
Meet Chair:
NMcCutcheon
Race Date:
2021/05/26
Race Number:
R 6
Decision:
Protest dismissed.
Facts:
Following the running of Race 6 (Fruitfed Supplies Hdcp) Mr P Didham, Trainer of RED RUFUS (3rd) protested against the first-placed horse EL NYMPH. The Information stated that the interference was in the final straight.
The Judge’s Placings were:
1st - EL NYMPH
2nd - AKELA BELLE
3rd - RED RUFUS
Margins:
Nose, ½ Head
Submissions for Decision:
Mr Didham said that near the 300m EL NYMPH took his horse’s line and although there was not great contact, his horse was a big horse and after the contact it wobbled and bobbled and he believed it should have won by a small margin.
Mr Goindasamy the Rider of RED RUFUS said that he had trailed the leader (EL NYMPH) and when he got up onto that runner, it came out and that his horse lost momentum and shied away from the grey horse (EL NYMPH). He added that it had cost his horse ½ length.
Ms Leighton the Rider of EL NYMPH said that her horse was laying out a little, but was clear of RED RUFUS and that it just fell away from her horse and SAVASTEP when between those horses. She added that RED RUFUS continued to run around and had had its chance to win.
Mr Elliott co-Trainer of EL NYMPH said that there was sufficient room and that RED RUFUS was green. He agreed with Ms Leighton that it had had its chance to win.
Mr Jones said that there was marginal room and that prior to EL NYMPH shifting SAVASTEP and RED RUFUS came together. He said that EL NYMPH shifted half a horse width making it tight. He said that RED RUFUS ran out from thereon and that it was not EL NYMPH’S fault. He added that the Stewards view was that there was insufficient evidence for the placings to change.
Reasons for Decision:
The Committee found that near the 300m EL NYMPH did shift and made slight contact with RED RUFUS, RED RUFUS shifted further away than was necessary and continued to shift about of its own volition in the run to the winning post.
The Committee determined that any shift by EL NYMPH did not cost RED RUFUS the winning of the Race.
