The protest was upheld and SQUIRE JOHN was relegated to 2nd placing.

Consequent upon the relegation, the amended result for the race is as follows:

1st  9 Rocket
2nd 6 Squire John
3rd 5 China Express
4th 8 Precious Moment
5th 1 Brite N Lovely
6th 2 Ruthless Success

The Committee was advised that there was a further protest pending against the horse placed 4th by the judge, PRECIOUS MOMENT. The order for payment of dividends and stake monies was withheld pending the outcome of that protest.

Facts:

Following the running of Race 3, “Download the New Addington App for Free” Trot, an information instigating a protest was filed by Stipendiary Steward, Mr N M Ydgren, against SQUIRE JOHN (P J Wakelin), placed 1st by the judge, on the grounds that the horse “galloped over the line”.

Ms Wakelin was not present at the hearing of the information. She had endorsed on the information form and signed “I do not contest relegation to 2nd”. Mr Ydgren confirmed that Ms Wakelin did not wish to be present at the protest hearing.

Rule 870 provides as follows:

(5) Notwithstanding the provisions of sub-rule (4) hereof any horse which is not in the correct gait when its nose reaches the finishing line which is lapped on by any other horse or horses in the correct gait shall be placed by the Judicial Committee behind such horse or horses provided that where such first mentioned horse is not in its correct gait as a result of interference to such horse or horseman, then (subject to Rule 869 (8) such relegation of the horse shall be at the discretion of the Judicial Committee.

Submissions for Decision:

Mr Ydgren had Stipendiary Steward, Mr R A Quirk, show a video replay of the concluding stages of the race. He pointed out SQUIRE JOHN, driven by Ms Wakelin, racing in the lead inside the final 50 metres, go into a gallop, free of interference, and continue in a gallop across the finishing line, finishing in 1st placing. Mr Ydgren alleged that SQUIRE JOHN was lapped on by the 2nd placed runner, ROCKET, which was in its correct gait. Mr Ydgren also produced the official photo finish of the race which confirmed that SQUIRE JOHN was lapped on by ROCKET.

Reasons for Decision:

The Committee was satisfied that SQUIRE JOHN broke, free of interference, short of the finishing line and had continued in a gallop to the finishing line. It was in a gallop when its nose reached the finishing line. The Committee was further satisfied that it was lapped on by the 2nd placed runner, ROCKET, in its correct gait.

The Committee also noted that Ms Wakelin, driver of SQUIRE JOHN, was not contesting the relegation of that horse to 2nd.
