Facts:
Following the running of Race 8 the “Caltex Westport Pace”, an Information was filed by Stipendiary Steward, Mr S Renault alleging a breach of Rule 869(2) by Open Driver, Mr J Geddes. The information alleged, You used your whip on more occasions than permitted by Clause (b) of the Use Of Whip Regulations.
Mr Geddes had signed the Information stating he admitted the breach and that he did not wish to be present at the hearing. This was confirmed by Mr Renault.
Rule 869 provides as follows:
(2) No horseman shall during any race use a whip in a manner in contravention of the Use of the Whip Regulation made by the Board.
The Use of Whip Regulation (effective from 30 November 2017) provide:
(b) No horseman is permitted to use their whip in a striking motion on more than ten occasions inside the final 400 metres. This is inclusive of “backhanders” and the use applies to the horse, harness and/or sulky.
Mr Renault used the race video to identify Mr Geddes driving (13) MOGUL, racing in the parked position outside the leader at the 300 metres. He pointed to Mr Geddes and counted 11 strikes with the whip in the run to the finishing post.
Mr Renault stated Mr Geddes agreed with the count of 11 strikes as did the Committee.

Mr Renault said Mr Geddes had driven 53 times last season and 12 this season. He said Mr Geddes had breached this rule on the 11th of February 2018 at Methven for which he was fined $200. With today’s breach being nearly 11 months on, Mr Geddes’s record has reset and is clear.
Mr Renault said the Stewards were seeking a fine of $200.
Reasons for Penalty:
The JCA Penalty Guide provides a sliding scale for a first offence where there have been 11 to 13 strikes which entails a $200 fine, mitigation inclusive.
The Committee finds this an appropriate penalty.
