Facts:
Following the running of Race 6, the “Whangaehu O’Learys Maiden 1200”, Information A11611 was filed by Stipendiary Steward Mr D Balcombe under Rule 638(3)(b)(ii). The Information stated "J Baillie used his whip excessively prior to the 100m without the necessary respite”. Mr Baillie signed the Information admitting the breach and at the beginning of the hearing confirmed that was correct and also that he understood the Rule and associated Guidelines under which he was charged.
Stipendiary Steward Mr Balcombe showed the side-on view of the race from just prior to the top of the home straight and the 350m mark and highlighted Mr Baillie racing close to or in the lead against the inside rail. He said from that point to the 100m Mr Baillie struck his horse 14 times and whilst there were some pauses none were for the required 5 strides.
Mr Baillie did not disagree with Mr Balcombe’s interpretation of the film and said he felt then when he used the whip his horse had responded positively but when he stopped using it it had started to not give of its best.
Submissions for Penalty:
Mr Balcombe said Mr Baillie had not breached this Rule in the previous 12 months. He asked the Committee to note whilst there were some pauses between the strikes none were for the required 5 strides and submitted a fine of $300 was an appropriate penalty.
Mr Baillie had no comments to make other than to say he had got over excited at the prospect of winning his first race since his return to riding.

The Committee has reviewed the film of the race from the top of the straight to the 100m mark and taken into account the submissions made. The JCA Penalty Guide starting point for a 1st breach of excessive use of the whip is a $300 fine which was adopted. This starting point includes admission of the breach and a clear record. There were no aggravating factors that warranted an uplift in penalty.
