Mr Karnicnik was fined $300.

Facts:

Following the running of R2 (Westbrook 2100), Information No.A7599 was filed with the Judicial Committee. It was alleged that Mr Karnicnik used his whip excessively on ROYAL SCEPTRE prior to the 200m.

Rule 638(3)(b)(ii) provides:
A rider shall not strike a horse with a whip in a manner or to an extent which is excessive.

Mr Karnicnik acknowledged that he understood the Rule and the charge, and he confirmed to the committee that he admitted the breach.

Mr Coles showed the film replays of the race and said that Mr Karnicnik had hit his horse 12 times prior to the 200m and that he did not give sufficient breaks between the strikes.

Mr Karnicnik agreed with Mr Coles’ interpretation and said that he did not give the required respite.

Submissions for Penalty:

Mr Williamson said that Mr Karnicnik had a clear record and that jumping riders have a limited season, as opposed to flat jockeys and submitted that a fine in the $200 range would be appropriate.

Mr Karnicnik said that this was his first offence under the Rule and that he agreed with the Steward’s submission.

Reasons for Penalty:

Mitigating factors were clear record and admission of the breach. The committee believed that a reduction on the JCA starting point of $500 was warranted on this occasion.
