As the breach was admitted we find the charge proved.

Penalty:

In fixing penalty the committee has adopted the standard 5 days as a starting point.  After giving Mr McKay credit for his admission of the breach which we assessed at the low end we find an appropriate penalty is a suspension of 4 days.  Accordingly Mr McKay is suspended from after racing on 21 January until after racing on 26 January 2015 (4 North Island days).

Facts:

Following race 3, Ladies Day 7 February 2015 1300, an information was filed by the informant Mr M Williamson.  He alleged Mr S McKay allowed his mount ALVESTA to shift outwards taking ELLUSIVE GOLD outwards on to TWYA which was checked and lost ground near the winning post. 

Mr McIntyre demonstrated the video films which showed ALVESTA racing in a two off position inside the final 100 metres.  He said Mr McKay directed his mount out when not sufficiently clear of ELLUSIVE GOLD (Z Moki).  This resulted in her moving out into the running of TWYA (M Sweeney) who stood up in the irons just short of the post when checked. 

Mr S McKay said his mount started to lean out early in the straight and he punched its neck in an attempt to straighten.  He conceded that in the last final stages of the race his mount rolled out further than he anticipated.

Mr P McKay said the head on film showed that in the last 50 metres Mr S McKay did allow his mount to roll out.  He admitted that Mr S McKay failed to straighten when he should have.

Submissions for Penalty:

Mr Williamson produced Mr McKay's record which showed 2 suspensions in the last 12 months.  He said he was a promising apprentice with a good future and his record was a fair one.  In today's charge he said Mr McKay allowed his mount to move out when under pressure while his obligation was to stop riding and straighten.

Mr S McKay said he had commitments up to and including 21 January and confirmed he only rode in the North Island.

Reasons for Penalty:

The committee carefully considered all evidence and submissions before imposing an appropriate penalty.  In mitigation Mr McKay admitted the breach and has a relatively good record for an apprentice.  However the aggravating factor was the check received by Mr Sweeney caused by Mr S McKay moving out when insufficiently clear.  This resulted in 2 horses being checked.  However the committee considers the breach to be at the low end.
