Charge:
Following race 3 an information was filed pursuant to Rule 636(1)(c). The informant Mr Williamson alleged that Mr Kasim failed to ride (LITTLE ROCKET) out over the concluding stages when the filly had a reasonable chance of finishing in a better position.
Facts:
In response to a question from the committee Mr Kasim acknowledged that he did not need any representation at the hearing and he understood the rule.
Mr Coles demonstrated the incident by using the video films. He pointed out to the committee on the head on film that Mr Kasim was riding his mount out towards the finish using the whip. However, 3 strides prior to the finish line it can be seen that Mr Kasim stands up in the irons when having a reasonable chance of finishing in 4th position. He confirmed the official margin between 4th and 5th placing was a nose.
In response Mr Kasim told the committee that his mount was a 2 year old having only its second start and it was never comfortable in the slow track conditions. He said that LITTLE ROCKET had been struggling in the ground from the half mile, noting that he was pushing her to make ground from the 600 metre mark. He said he had used the whip on the horse in the final straight and had put it away because he believed she was giving her best. He admitted to sitting up in the final 3 strides as he thought the filly had enough.
Mr Williamson when summing up said LITLE ROCKET was vet checked after the race and no abnormalities were found. He said it was clear that Mr Kasim had sat up and placed emphasis on the words “reasonable chance” under this Rule.
Submissions for Penalty:
Mr Williamson produced Mr Kasim's record which showed no previous breaches of this rule. He said Mr Kasim has an obligation to ride out his mount to the finish line and noted there was a difference of $350 between 4th and 5th prize money. He submitted that the first four investors were affected by his actions. He referred to similar breaches of this rule which ranged from $550 fines to 2 and 4 day suspensions. He said the stewards would be seeking a fine of $500 to $1,000 or a suspension similar to recent charges.
Mr Kasim submitted he would prefer a fine over a suspension and was in a financial position to pay a fine. When asked by the committee as to his riding commitments Mr Kasim said he was riding at Otaki on 1st May. In response to a question from the committee Mr Kasim advised us he had no commitments at Ruakaka on 2nd of May 2012.

The committee carefully considered all the evidence and submissions presented. The mitigating factor is Mr Kasim's admission of the breach and his clear record. We assess the breach to be at the low end of the scale. The aggravating factors are that Mr Kasim failed to ride his mount out to the finish line when he had a reasonable chance of finishing in 4th position. The committee did place some emphasis on the fact that it was a 2 year old event and the slow track conditions. The films showed that LITTLE ROCKET was struggling in the ground however this does not permit riders to sit up prior to the finish line. The committee believes a fine is an appropriate penalty on this occasion after considering all the relevant facts.
The committee advised Mr Kasim that any further breaches of this rule would result in a suspension.
