The protest was upheld and THANESAN was disqualified from the race. As a consequence of the disqualification, the amended result for the race is as follows:

Facts:

Following the running of Race 8, Neumanns Bandag Hambletonian Classic Mobile Trot, an information instigating a protest was filed by Stipendiary Steward, Mr S P Renault, against THANESAN (A M Butt), placed 5th by the judge, on the grounds of breaking from its gait and failing to promptly regain its proper gait and a breach of the Breaking Horses Regulation.

Mr A M Butt, the driver of THANESAN, had endorsed and signed on the information form “I do not contest the protest”.

Rule 869 provides as follows:
(3) Any horse which breaks from its gait shall promptly regain its proper gait.

The Breaking Horses Regulation provides as follows:
For the avoidance of doubt and in order to clarify the situation for all parties concerned, the following shall apply with regard to breaking horses:
(b) Any horse which breaks from its gait within the final 200 metres of any race and continues on in the break for a distance of 50 metres or greater, shall be deemed to be in breach of Rule 870 (3) in that it has failed to promptly regain its proper gait.

Where a protest has been duly lodged against the placing of an offending horse, the Judicial Committee shall either:
(i) relegate such horse under Rule 870 (4) to behind any other horse in respect of which an advantage may have been gained; or
(ii) disqualify it from the race under Rule 1003 (2).

Submissions for Decision:

Mr Renault showed a video replay of the final 200-300 metres of the race. He pointed out THANESAN, driven by Mr Butt, improving into 3rd place with approximately 100 metres to run. It then went into a break and continued on in a gallop until past the finishing line, finishing in 5th placing. Mr Renault pointed out the mark 50 metres from the finishing line. The horse had galloped for a distance well in excess of 50 metres, he alleged, approximately 100 metres. The Stewards sought disqualification of THANESAN, he said.

Reasons for Decision:

The Committee was satisfied that THANESAN had broken from its gait within the final 200 metres of the race and continued on in the break for a distance of approximately 100 metres. In terms of the Breaking Horses Regulation, in doing so, the horse breached Rule 870 (3) in that it failed to promptly regain its proper gait.
