Charge:
J Lynds presented Booming to race without a tongue tie which it had worn at its previous start.
Facts:
Following Race 8 Mr J Lynds was charged with a breach of Rule 616(2)(a).
The rule reads:
A horse which runs with an item or items of Notifiable Gear in a Race:
(a) which is a Flat Race, shall not run without such item or items of Notifiable Gear in its next consecutive Race unless such Race is a Jumping Race, or permission to start the horse without any, some or all such items of Notifiable Gear is obtained from a Stipendiary Steward.
Mr Lynds admitted the charge therefore it was found proved.
Mr Goodwin explained to the committee that Mr Bateup (assistant Stipendiary Steward) noticed at the plate inspection area that the horse Booming was not wearing a tongue tie which was part of its approved racing gear.
When questioned by Mr Bateup Mr Lynds said that Booming was "not going to wear a tongue tie today".
Mr Lynds told the committee that he was late saddling Booming up and by the time the tongue tie was noticed missing, by Mr Bateup, he did not have time to return to the boxes and get it. He said that would have taken him at least 10 minutes and he didn't have that long.

In relation to penalty Mr Goodwin said that breaches of this rule usually attracted a fine of $100.
Mr Lynds said that it was announced over the on-course speaker system that Booming would be starting in the race without a tongue tie therefore there wasn't a problem and "all was conformed to".
Reasons for Penalty:
The committee took into account all of the submissions including Mr Lynd's admission of the breach. We did not however agree with his assertion that there was no problem with Booming not wearing a tongue tie. Whilst the on-course patrons had been made aware of the change of gear off-course patrons did not have the same advantage.
We could see no reason to depart from the standard fines imposed.
