Facts:
Mr Coles demonstrated the video films and pointed out to the committee Mr J Collet rider of NOVEMBER RAIN make a celebratory gesture prior to the finishing line. Mr Coles said it was clear that 2 strides before the post Mr Collett's arm went up which allowed NOVEMBER RAIN to duck in and into the line of OBSESSION causing its rider Mr Cameron to check.

Mr Collett stated his inward movement was gradual and his mount did not duck in as alleged.

Mr Oatham said this was Mr Collett's second charge under this rule in the last 3 months. He said the rule was there for one of safety which was compromised on this occasion by Mr Collett. Mr Oatham said Mr Cameron was in danger of clipping a heel when NOVEMBER RAIN moved into his line. He submitted a fine of $500 - $750 would be appropriate.
Reasons for Penalty:
The committee considered all evidence and submissions. We find this particular case more serious than most under this rule. Mr Collett's actions could easily have had serious repercussions through him taking his arm of one rein which allowed his mount to move in. This movement caused him to take the line of OBSESSION which had to be checked as a result. Another aggravating factor is that this is Mr Collett's second charge under this rule in 3 months.
