Decision:

"Cyclone Jeter" is disqualified from the "Clarkville Stockfeeds-North CanterburyTrotting Trot".

Amended placings are:

  1. Horse 2   - "Millicent"
  2. Horse 7   - "Xmas Joyella"
  3. Horse 3   - "Charming Lavra" -
  4. Horse 1   - "Petite Royal"
  5. Horse 16 - "Natural" 

Stakes and dividends are to be paid accordingly.

Facts:

In Race 4, the "Clarkville Stockfeeds-NorthCanterbury Trotting Trot", when the field came to the 100 metres point before the winning post "Cyclone Jeter" (N McGrath), broke from its gait of its own accord, and continued in a break until the winning post. The video coverage of the incident was shown to the hearing which showed quite clearly that  the horse was in a break and accordingly in contravention of the rule and the regulations.

Mr McGrath endorsed the information indicating that he did not contest the protest and that he did not wish to be present at the hearing.

Submissions for Decision:

Mr Ydgren submitted that as there was a clear breach of Rule 870(3) and the Breaking Horses Regulations, that the horse should be disqualified.

Reasons for Decision:

As "Cyclone Jeter" was clearly in a break for a distance of at least 100 metres within the final 200 metres of the race, there has been a clear breach of Rule 870(3) and the Breaking Horses Regulations.
