Facts:
Following the running of Race 4, the Kaikoura Building Centre ITM Pace, an Information was filed by Stipendiary Steward N Ydgren against Licensed Open Horseman Mr D White, alleging a breach of Rule 869(2)(a) in that he used his whip in an excessive manner over the concluding stages.
Rule 869(2)(a) reads as follows:
“(2) No horseman shall during any race:-
(a) Use his whip in an unnecessary, excessive or improper manner.”
Mr White had endorsed the Information that this breach of the Rules was admitted. Mr White had also informed the Stewards that he did not wish to be present at the hearing.
Submissions for Decision:
Mr Ydgen gave evidence and showed video replays of the run home. He pointed out Mr White driving DONNY JONES four back on the inner as the field turned for home. He showed Mr White draw his whip and use it on 24 to 25 occasions in the run home. Mr Ydgren submitted that this was excessive by the sheer number of strikes. He also said that there were no discernible pauses during the final stages and that the whip use was continuous.
Reasons for Decision:
As Mr White had admitted this breach of the Rules it was found to be proved in accordance with Rule 1111(1)(d).
Submissions for Penalty:
Mr Ydgren stated that Mr White had previously driven in Australia and had been in New Zealand for the last 2 months or so. He said he had driven on several occasions during this period and had been given a copy of the Whip Guidelines. He stated that Mr White had a clear record and had readily admitted the breach. He said the JCA Penalty Guide recommends a starting point of $300 or 6 drives for a breach of this rule and submitted that a fine of $200 be considered as penalty in this case.

In determining penalty we took the JCA Penalty Guide recommendation of $300 for a breach of this Rule, as a starting point. We were able to give Mr White credit for his frank admission of the breach. For this we were able to give Mr White a discount of $50. We were also able to give Mr White a further discount of $50 for his clear record. We therefore determined that an appropriate penalty on this occasion was a fine of $200.
