As Mr Cusdin had admitted this breach of the Rules it was found to be proved in accordance with Rule 1111(1)(d).
Penalty:
Accordingly Mr Cusdin’s Junior Horseman’s Licence was suspended from after the completion of racing today, the 12 December 2010, until after the completion of racing on 19 December 2010, which is effectively a three day suspension. The three days are Timaru HRC at Addington on 16 December 2010, Wairio TC on 18 December 2010, and Rangiora HRC on 19 December 2010.
Charge:
Following the running of Race 2, the Placemakers Ashburton Mobile Pace, an Information was filed by Stipendiary Steward Mr N. M. Ydgren against Junior Horseman Mr B. H. Cusdin alleging a breach of Rule 869(2)(a) in that he used his whip excessively.
The charge reads as follows.
“I the above named informant allege that the above named Defendant committed a breach of Rule 869(2)(a) in that Mr Cusdin while driving Miss Dorie in the run home implemented his whip on at least 30 occasions which Stewards deem to be excessive.”
Rule 869(2)(a) reads as follows.
“(2) No horseman shall during any race:-
(a) use his whip in an unnecessary, excessive or improper manner.”
Facts:
Mr Cusdin had indicated on the Information that this breach of the Rules was admitted, and also that he did not wish to attend the hearing.
Mr Ydgren gave evidence and used video coverage to show that Mr Cusdin had used his whip on at least 30 occasions in the run home.
Submissions for Penalty:
In relation to penalty Mr Ydgren advised that Mr Cusdin had no relevant previous convictions, and had admitted this breach of the Rules. Mr Cusdin had advised him that he would prefer a suspension to a fine. Mr Ydgren submitted that a suspension of 3 driving days should be imposed in this case.
Reasons for Penalty:
We were satisfied, in line with previous penalties imposed for similar breaches of this Rule, and after hearing submissions, that a three day suspension should be imposed in this case.
