As Mr Khairil has admitted the charge it is found proved.

I Khairil on weighing in was 1 kg in excess of his weigh out weight

Rule 648(5) reads as follows:

"If the Rider of a horse weighs in at a weight of 1 kg or more in excess of that at which the Rider weighed out, the Clerk of Scales shall record the weight by which the Rider on weighing in exceeded the weight at which he weighed out and inform a Stpendiary Steward and that Rider commits a breach of these Rules"

Facts:

At the weigh-in, following the running of Race 2, the defendant, I Khairil the rider of "Waiting" was found to be 1 kg in excess of his weigh-out weight. Mr Khairil was accompanied in the hearing by Mr Shane Marr, Licensed Trainer.

In explanation, Mr Khairil said that his horse had sweated profusely and he wondered if  the sweat which had been absorbed into his saddle cloth could have contributed to the additional weight. He also said that he had been "wasting" in order to meet his carded weight and that he had a drink after the weigh-out.

Mr Oatham observed that the offence was a strict liability offence.

Submissions for Penalty:

Mr Oatham told the hearing that Mr Khairil had been charged with a similar offence on 11th November 2009 and was fined $200. He submitted that a similar penalty was appropriate.

Neither Mr Khairil or Mr Marr had any submissions to make on the question of penalty.

Reasons for Penalty:

After giving due consideration to the matter, and there being no aggravating features, the committee considered that a fine of $200 was appropriate.
