Facts:

Following the running of Race 11 (Happy 60th Russell Wright Hdcp), Information No. A12928 was filed with the Judicial Committee. It was alleged by the Informant that Mr Riddell the Rider of VERRY FLASH used his whip excessively prior to the 100m.

Mr Riddell advised the Committee that he understood the Charge and confirmed that he admitted the Charge.

Ms Algar showed the film replays and said that Mr Riddell had struck his mount with the whip 8 times prior to the 100m (5 is the limit).

Submissions for Penalty:

Mr Jones said that Mr Riddell had an excellent record under the Rule and added that he had not had a careless riding charge in the last 12 months.

Mr Riddell for his part said that it was a total lack of judgement. He said that he usually counts the number of strikes but failed to do so on this occasion. He concluded by saying that he had worked hard at getting his whip use under control and was proud of his record.

Reasons for Penalty:

Mr Riddell has an excellent record, however a discount was not afforded as excessive use of the whip is inexcusable under any circumstance.
