DECISION OF APPEALS TRIBUNAL

[1] Mr B Littlejohn appealed against the decision of the officiating raceday steward at Manukau on 17 July last that his dog KARLA LEWINSKY had breached r 80.1.b of the New Zealand Greyhound Racing Association (Inc) Rules of Racing. The penalty incurred was a 3 months’ stand-down.

[2] The respondent does not contest the appeal, which is thus upheld. The penalty imposed upon KARLA LEWINSKY is amended to a 10-day stand down on veterinary advice. The appellant consents to this alteration.

[3] The appellant has filed a deposit of $250. This is to be returned to Mr Littlejohn.

[4] There is no order as to costs.

[5] This decision was recorded by way of a minute dated 27 July. Mr Littlejohn has submitted that he wishes the decision of this Tribunal to record the fact that KARLA LEWINSKY has not previously been in breach of r 80 and, should there be any future allegation of failing to chase the lure, that the dog be treated in accordance with r 80.1.b.i. This information was not before this Tribunal on 27 July as the dog’s record was never produced. However, we accept that Mr Littlejohn’s request is reasonable and have made inquiry of the Racing Integrity Unit as to KARLA LEWINSKY’s racing record.

[6] The Racing Integrity Unit has undertaken to contact GRNZ and to ensure that the entry of a breach of r 80 on 17 July last is removed from KARLA LEWINSKY’s record. Thus, should there be any future allegation of failing to chase the lure, the dog will be dealt with pursuant to r 80.1.b.i.
