Facts:
This is an uncontested protest instigated by Stipendiary Steward, Mr J Muirhead following the running of race 7, the FRUCOR CLASSIC MOBILE PACE 2200m. The basis of the protest is that BETTORBEASTAR (Mr McKendry) interfered with the chances of PACIFIC RAPTURE (J Abernethy) with approximately 50 metres to run. BETTORBEASTAR was provisionally placed 4th and PACIFIC RATURE was provisionally placed 6th.

4th - BETTORBEASTAR
5th - GOLDEN DELIGHT
The official margins were ½ length, ¾ length, and a nose.
Submissions for Decision:
Mr Muirhead advised the Judicial Committee (the “Committee”) that Mr McKendry, the driver and trainer of BETTERBEASTAR told the Stewards and the duty Registrar that he does not contest the protest and did not wish to be present at the hearing. The Information was endorsed to that effect.
Mr Muirhead demonstrated the incident using head and rear view video film. He submitted that approximately 50 metres from the finish Mr McKendry angled BETTORBEASTAR into a gap and forced PACIFIC RAPTURE over the pylons causing it to lose ground and was impeded in its progress over the concluding stages.
Mr Abernethy submitted that PACIFIC RAPTURE would have finished at in least 3rd or 4th placing had his progress not been impeded by BETTORBEASTAR.
Reasons for Decision:
Notwithstanding the protest is uncontested. The front and rear video film of the concluding stages of the race clearly indicate BETTORBEASTAR did move inwards and cause PACIFIC RAPTURE to shift onto the pylons and lose ground.
